- Agreement Overview
1.1. These Terms and Conditions (“Terms”) form a legally binding agreement between OJM Web Design (“we,” “us,” or “our”) and the client (“you” or “your”) for the provision of website design services and booking of our services.
1.2. By engaging our services or accessing our website at design.ojmbusinesses.co.uk, you agree to be bound by these Terms.
- Services and Scope of Work
2.1. We agree to provide website design services as outlined in the proposal or agreement.
2.2. Any added services requested by you will be subject to additional charges and may require a separate agreement.
- Booking and Payment
3.1. To secure our services, a non-refundable booking fee may be needed, as specified in the proposal or agreement.
3.2. The remaining fees are due according to the agreed-upon schedule. Failure to pay may result in the suspension of services or termination of the agreement.
- Client Responsibilities
4.1. You agree to provide prompt and accurate information necessary for the completion of the project.
4.2. Delays caused by your failure to fulfil your responsibilities may result in added charges and extensions of the project timeline.
- Intellectual Property
5.1. Upon full payment, you will own the intellectual property rights to the final website design. Until then, all intellectual property stays the property of OJM Web Design.
5.2. We keep the right to display the completed project in our portfolio and marketing materials.
- Confidentiality
6.1. Both parties agree to keep confidential any proprietary or confidential information obtained during the course of the project.
- Termination
7.1. Either party may terminate the agreement with written notice if the other party breaches a material term of the agreement.
- Limitation of Liability
8.1. To the extent permitted by law, OJM Web Design shall not be liable for any indirect, consequential, or incidental damages arising out of or related to the services provided.
- Booking Cancellation
9.1. If you wish to cancel the booking, the non-refundable booking fee will apply. Additional cancellation fees may be applicable, as specified in the proposal or agreement.
- Governing Law
10.1. These Terms shall be governed by and construed in accordance with the laws of the United Kingdom.
- Changes to Terms
11.1. OJM Web Design reserves the right to update or change these Terms at any time. The updated Terms will be effective upon posting on our website.
